Stop the Wait: Remove Harmful Health Care Barriers for Individuals with Disabilities

Washington, D.C. – U.S. Representative Lloyd Doggett (D-TX), Ranking Member of the House Ways and Means Health Subcommittee, with Senator Bob Casey (D-PA), Chair of the Senate Special Committee on Aging, and Representative Brian Fitzpatrick (R-PA), Member of the House Ways and Means Health Subcommittee, just introduced the Stop the Wait Act (H.R. 883 and S. 320) to end the harmful waiting periods during which Americans with serious disabilities are denied access to Medicare.

After enduring an often-long application process to receive Social Security Disability Insurance (SSDI) benefits, beneficiaries are barred from receiving payments for the five-month period following the onset of their disability. They must also wait 29 months—a 24-month waiting period after the start of their disability payments—to receive health insurance through Medicare. More appropriately described as “suffering periods,” an estimated 1.6 million Americans are currently stuck in the Medicare waiting period and, in 2018 alone, about 56,000 individuals died waiting for Medicare coverage to begin.

The Stop the Wait Act directs the Social Security Administration to phase out the five-month waiting period to receive SSDI benefits and allow those who are uninsured or unable to afford health insurance to immediately receive Medicare coverage.

“There is no justification for these delays, which deny millions of Americans access to health careand other supports when it is needed most,” said Congressman Doggett. “Restrictions designed to cut costs simply shift costs onto patients when they are most vulnerable. Ending these egregious suffering periods is all the more urgent as more Americans experience Long COVID— a condition that represents the largest new entrant to the disability community in modern history.”

“Social Security and Medicare benefits are crucial for many Americans with disabilities and those waiting for critical care, and those programs must be widely accessible without waiting periods,” said Congressman Fitzpatrick. “The waiting period for those who suffer from disabilities to access the benefits they have earned is arbitrary and unnecessary, and I’m proud to co-lead this bipartisan legislation to get rid of these delays.”

“When you pay into the Social Security Disability Insurance fund, you are entitled to your benefits—that’s the way it should be,” said Senator Casey. “Many people with disabilities, however, must endure lengthy waiting periods to receive benefits and critical health care. The Stop the Wait Act would eliminate these dangerous waiting periods and provide access to necessary benefits and often life-saving care.”

Last year, then-Chairman Doggett convened a House Ways and Means Health Subcommittee hearing to examine health access challenges faced by people with disabilities, including the 24-month Medicare waiting period.
